1. Acceptance of Terms

By accessing or using StreamKit, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the service. Your continued use of StreamKit following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

StreamKit by Pencipta provides web-based streaming tools designed for content creators, gamers, and professional streamers. These tools include stream decks, timers, scrolling text overlays, chat overlays, face effects, and frame templates. All tools are accessible via web browser and embeddable in OBS Studio, XSplit, or any software that supports browser sources.

StreamKit is available at streamkit.pencipta.com. Features, functionality, and tool availability may change at any time as we improve and expand the platform.

3. Account Registration

Access to StreamKit requires a StreamKit account. Accounts are created via Google Sign-In (Google SSO). You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 13 years of age to create an account and use StreamKit.

You must not share your account credentials with others or allow unauthorized access to your account. If you suspect unauthorized use of your account, you should contact us immediately.

4. User Content

You retain all rights to content you create, upload, or configure within StreamKit, including overlay designs, media assets, text configurations, and stream deck layouts. By using StreamKit, you grant Pencipta a limited, non-exclusive license to host, store, and serve your content solely for the purpose of displaying your overlays and tools during your streams.

You represent and warrant that you have the right to use any content you upload or incorporate into your StreamKit configurations. You are solely responsible for ensuring your content does not infringe on the intellectual property rights of third parties.

5. Acceptable Use

You agree not to use StreamKit for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. You must not:

• Use StreamKit to distribute malware, spam, or other harmful material
• Harass, threaten, or intimidate other users or viewers
• Circumvent or attempt to circumvent access controls, rate limits, or security measures
• Resell or redistribute the service without prior written authorization from Pencipta
• Attempt to reverse-engineer, decompile, or disassemble any part of the StreamKit platform

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Subscription & Billing

StreamKit offers subscription plans as described on our pricing page at streamkit.pencipta.com. Plans auto-renew at the end of each billing period unless you cancel your subscription before the renewal date.

We reserve the right to change pricing with at least 30 days' advance notice. Existing subscribers will be notified of any pricing changes via email. Refunds are handled on a case-by-case basis at our sole discretion.

7. Intellectual Property

The StreamKit name, logo, interface design, documentation, and underlying code are the intellectual property of Pencipta and are protected by applicable copyright, trademark, and other intellectual property laws.

Your overlay and tool configurations created within StreamKit remain your intellectual property. Nothing in these Terms transfers ownership of your content to Pencipta.

8. Service Availability

StreamKit is provided as-is. While we strive for high availability and reliability, we do not guarantee uninterrupted or error-free service. We may perform maintenance, update features, or modify functionality at any time with or without notice.

We are not liable for any downtime, data loss, or service interruptions that may affect your live streams or recorded content.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Pencipta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of StreamKit, including but not limited to loss of data, loss of revenue, or interruption of live streams.

In no event shall Pencipta's total liability exceed the amount you paid for StreamKit subscriptions in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

You may delete your account and stop using StreamKit at any time through your account settings. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or for any other reason at our discretion.

Upon termination, your data will be deleted within 30 days, except where retention is required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination will remain in effect.

11. Changes to Terms

We may update these Terms of Service periodically to reflect changes in our practices, technology, or legal requirements. Material changes will be communicated via email or in-app notification at least 14 days before they take effect.

Your continued use of StreamKit after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the service and delete your account.
